a.      Nominate and confirm a new Land Use Appeals Board Chair for 2008.

 

b.      Vote to adopt the updated Land Use Appeals Board Policies & Procedures

 

  1. PUBLIC HEARING

a.      Case  08-002: Urbana on 11th Condominiums – A request by Gardiner Properties, LLC, represented by John Gardiner, to appeal Condition #6 imposed by the Planning Commission as part of the site design approval for Petition 430-07-05.  This condition requires a 15 foot setback at the brick face of the northwest corner at approximately 30 feet or the fourth and fifth floors of the project.  The appellant’s claim is that the Planning Commission exceeded their authority with respect to the building and site design review and impermissibly placed additional requirements and hardships on the appellant that are not allowed under the applicable ordinance. Although a public hearing will be held, the Land Use Appeals Board will only receive comments from the petitioner and the City staff member representing the Planning Commission.  No new evidence should be presented to the Board unless such evidence was improperly excluded before the Planning Commission.  For additional information, please call Andrea Curtis at 535-6230.
