2009 ZAP PROJECT

2009, the Planning Division will embark on a long range planning project
to make major revisions to the Zoning Ordinance.

Citizen Focus Group
A Main public
input format is through the ZAP Task Force. The
Task Force is a group of Citizens interested in Planning Issues who have
volunteered their time to act as a focus group to provide comments and
act as a sounding board to give the Planning Staff feedback on the
proposed amendments relating to the ZAP project.
The Task Force is
made up of a group of various interests, identified by the City Council
and its staff during the 2008 Conditional Use Amendment Process.
Members from City Boards and Commissions, Business Groups, Business
Owners, Community Council Leadership, Residents, Repeat Applicants and
Development Experts represent a diverse and geographically
representative makeup of the City. The Group is respectful of one
another and members provide effective dialogue giving the Planning Staff
valuable insight on whether the ideas of how to improve the processes
and regulations are appropriate.
The Task Force began
meeting in February and have agreed to continue to meet approximately
twice a month to review the various tasks of the ZAP project through
2009. Their continued commitment to this project will help ensure
the Planning Division will continue to obtain quality input from a
diverse citizenry to help the Planning Commission and City Council make
the decision to ensure the zoning regulation help implement the policies
of the City.

Text Amendment Standards
The
existing text has criteria that apply more to zoning map amendments than
they do to zoning text amendments. This project includes creating
different standards for zoning text amendments and map amendments. For

regulations and amending them to be consistent throughout the ordinance

Purpose
Statements for Zoning Districts
The intent of reviewing the purpose statements for each zoning district
is to identify conflicting language within individual purpose
statements; determining if the individual statements are adequate to
convey the general purpose of the zoning district and if the specific
zoning districts standards support the purpose statement. The proposed
end product will produce purpose statements that are consistent with the
overall purpose of the zoning district and of each zoning chapter
(Residential, Commercial, Downtown, Special Purpose, etc.), to assist in
making administrative interpretations and implementing the policies
identified in applicable master plans. For comments or information

Conditional
Use Standards
This project includes amendments to various sections of the Conditional
Use chapter of the Zoning Ordinance. The areas of study include
clarifying whether or not an approval of a conditional use should be
linked to the applicant or to the property; whether a conditional use
can be converted to a similar use without a new approval, refining and
making recommendations on the cumulative adverse impact standard; and
determining whether the criteria and standards for a conditional use
should be revised to meet the intent of the City Council, provide
clarity, remove redundancy and uphold State Law (LUDMA) while still
providing the decision makers with the flexibility to approve or deny a

Non-Conforming
/ Non-complying Standards
This project includes in-depth refinement and clarification of existing
regulations relating to non-conforming uses and non-complying structures
and lots. Specifically, the project will analyze compliance with State
Law (LUDMA), clarify the regulations relating to in-line additions;
address expansion and changes of use regulations, and provide options to
terminate Non-Conforming Uses and Non-Complying status. For comments or

Conditional
Building & Site Design Review Standards
In July 2008, the City Council adopted revised standards related to
building and site design review. The City Council has requested the
Planning Staff to provide further clarification and refinement to the
standards. The purpose of these regulations is to provide for the
flexible implementation of the specific design requirements set forth in
various zoning districts. Furthermore, the design review process is
intended to help ensure that newly and redeveloped properties are
designed to encourage pedestrian access, circulation and orientation,
while acknowledging the need for transit and automobile access. For

Special
Exceptions
Special Exceptions (use related): The purpose of this task is to
focus on the existing Special Exceptions relating to use (such as hobby
shops, studios in accessory structures, conditional home occupations and
home daycare) and determine if they can be allowed as permitted uses (if
they meet specific standards) or if a process can be developed to
provide notice of approval of an application that meets the standards,
with an appeals process. In addition, because the matter relates to
use, the ultimate decision making authority would be transferred from
the Board of Adjustment to the Planning Commission.
Special Exceptions (design and location related): The purpose of this
task is to focus on the existing Special Exceptions relating to design
(such as fence height and additional building height) and Special
Exceptions relating to location (such as front yard parking and window
mounted swamp coolers) and determine if they can be permitted uses or if
a process can be developed to provide notice of approval of an
application that meets the standards, with an appeals process. In
addition, because the matter relates to design and location the ultimate
decision making authority would be transferred from the Board of
Adjustment to the Planning Commission. For comments or information

Planned
Development Regulations
The City Council and the Planning Commission initiated legislative
intents requesting that Planning Staff analyze the feasibility of
reducing the minimum parcel size eligible for the planned development
process for various zoning districts, as well as analyzing the
appropriateness of increased density through planned development
regulations. This project includes analyzing these issues, as well as
others identified as appropriate amendments to the planned development

Zoning
Map Changes
This project includes analyzing the areas that are currently zoned for
multi-family zoning classifications and determining whether it may be
appropriate to rezone the properties for one of the mixed-use zoning
districts. The analysis will be based on master plan policy, location
on block, other uses and zones that abut the property and the
classification of the street. Staff will also review where the
Residential Business zoning district is currently zoned to determine
whether some RB properties should be rezoned to more appropriate zones
and whether there are other properties in the City where RB zoning is

Tables
of Permitted & Conditional Uses
This project includes reformatting the tables to be easy to use and
relocating all use tables into one chapter of the zoning ordinance for
easier reference. This project also includes reviewing the use tables
to ensure the uses are appropriate for the zones and to add or remove
uses from the zoning districts where appropriate. This project will
commence once the amendments to the Purpose Statements for the various

of Uses
This project includes modifying the use tables to ensure consistency in
naming of uses and terms; ensuring that each use listed has a clear and
comprehensive definition of the use. This project will commence once
the amendments to the Purpose Statements for the various zoning

Off-Street
Parking Regulations & Policies
The City Council adopted amendments to the parking regulations in July,
2008. This project includes consideration of the expansion of
shared/alternative/off-site parking; discouraging the development of new
parking lots in the residential zoning districts; distinguishing between
short term and long term parking in park and ride lots in neighborhoods,
and considering incentives for incorporating transit use into
